Message Ok guys. Last week, I had another engine put in my 300zx TT. Free because it was under warranty. SO, I went to the shop to test drive it. I get the keys. I ACCIDENTLY push the Remote start button, ment to push the open door button, so anywas, who cares right. SO, The car starts and im infront of it and it starts to go in a first gear role, pushing me, with me running back with it, basically panicing, trying to get outa the way, and it smashes me into the side of another car... moving it 3 feet, crushing my legs. It moved the other car three feet and you can see my leg imprints on the other car.

So, basically, the mechanics reverse parked the car, then put it BACK in first gear and did not pull the E-Brake... and this is what happened...

Let me also say that the car was converted to 5 speed 6 months before this happened along with the first engine swap. They rigged it, without telling me, did not find out till after this accident, that you do not have to push the clutch in to start the car. I drove a 300zx N/A for 2 years before i bought this car and I always had to push down the clutch to start the car... Let me also say the remote start came with the car when i bought it, I did not have it installed.

So anywas, I have a knee joint injury, im so lucky i didnt fall or break anything.

My Question is this:

Does anyone have a car manual handy for a 5 speed that it might give instructions on how to leave a car when your done driving it.. Basically the manual stating to turn off the car in nuetral and pulling the E-brake before starting or turning off the car for 'safety' purposes...

If it says this then well I have even better case..

Also, my insurance company just stated that they will not cover the damages and the shop is at fault becuase of neglegence and will have to repair my car and the other persons car.

Anywas, I hope thats not a stupid question but your help would be greatly appreciated.
